(FOIE GRAS/ANIMAL CRUELTY) CALIFORNIA — Foie gras, a French delicacy made from duck or goose liver, will continue to appear on menus throughout California, despite activists’ call for a ban.

To create foie gras, producers fatten the duck or goose liver by cruelly force feeding the animal. At foie gras farms, force feeding involves shoving a metal tube down the animals’ throats to inject corn into their bodies, which induces an enlarged and diseased liver.

This cruel practice was banned in the state of California in January of 2012, causing animal activists around the state to rejoice. However, on January 7th, 2015, the U.S. District Court overturned the California law (Cal. Health & Safety Code § 25982) prohibiting the sale of foie gras.

Mercy for Animals (MFA) conducted an undercover investigation at Hudson Valley Foie Gras–one of the plaintiffs involved in the lawsuit and one of the nation’s largest foie gras factory farms–to document the violence involved in foie gras production.

According to the judge in the foie gras lawsuit, the process of force feeding was considered an ingredient, and therefore falls under federal, rather than state law.

Nathan Runkle, the founder and president of the MFA, said:

“The district court’s misguided decision to allow the sale of cruelly produced foie gras in California is a grave miscarriage of justice. The ruling is contrary to both law and common sense, and we are confident the law will be upheld on appeal.

The people of California clearly have the right to prohibit the sale of a product that is the result of abject animal abuse. If production practices are now “ingredients” then state laws regulating food safety, workers’ rights, environmental protection, and countless other important issues would be invalidated by this outrageous ruling as well.”
